1. Overview
Welcome to Greenock Creek Wines.
These Terms of Service (“Terms”) govern your use of our website, online store and related products and services (collectively, the “Services”).
The terms “we”, “us” and “our” refer to GREENOCK CREEK ESTATE WINES (SA) PTY LTD (ABN 95 628 302 607), trading as Greenock Creek Wines.
Our online store is powered by Shopify, which enables us to provide the Services.
By accessing or using our website, creating an account, placing an order, joining our Wine Club, booking an experience or otherwise using our Services, you agree to these Terms and our Privacy Policy.
If you do not agree to these Terms, you should not use our Services.
2. Age Restrictions and Responsible Sale of Alcohol
You must be 18 years of age or older to purchase alcohol from Greenock Creek Wines.
By purchasing alcohol through our website, you confirm that:

you are at least 18 years of age;

any date of birth or age information you provide is accurate;

you will not purchase alcohol on behalf of a person under 18; and
-
you will not arrange for alcohol to be delivered to or accepted by a person under 18.
We may request your date of birth or other information reasonably required to verify your age or comply with applicable liquor licensing laws.
Alcohol deliveries must be made in accordance with applicable liquor laws. The person receiving a delivery must be 18 years of age or older and may be required to provide acceptable proof of age and identity.
We reserve the right to refuse or cancel an order where we reasonably believe that the purchaser or recipient is under 18, has provided inaccurate age information, or where fulfilling the order would breach applicable liquor licensing requirements.

3. Account and Customer Information
You may be asked to provide information including your name, email address, date of birth, billing information, payment information and delivery address.
You agree that the information you provide is accurate, current and complete.
You are responsible for maintaining the confidentiality of any account credentials and for activity carried out through your account.
You should notify us as soon as reasonably possible if you believe your account has been accessed without authorisation.
4. Products, Wines and Vintages
We make reasonable efforts to ensure that product descriptions, wine information, vintages, images, availability and other information shown on our website are accurate.
However:
-
product appearance may vary slightly from images displayed online;
-
packaging, labels and presentation may change from time to time;
-
availability may change without notice; and
-
limited-release, museum and allocation wines may sell out quickly.
Where a specific vintage is stated in a product listing, we will not intentionally substitute another vintage without notifying you or obtaining your agreement where appropriate.
We reserve the right to reasonably limit quantities available for purchase, particularly for limited-release, museum, allocation or other scarce wines.
5. Pricing, GST and Payment
Unless otherwise stated, prices displayed on our Australian website are in Australian dollars (AUD) and include Goods and Services Tax (GST) where applicable.
Delivery charges and any other applicable charges will be shown or otherwise communicated before you complete your purchase.
Prices, promotions and discounts may change from time to time. The price applicable to an order will be the price displayed or quoted when the order is submitted, subject to correction of genuine errors as permitted by law.
We may offer promotional discounts, Wine Club member pricing or other special offers subject to additional conditions.
You agree to provide valid and accurate payment information and confirm that you are authorised to use the payment method provided.
6. Orders and Order Acceptance
Submitting an order constitutes an offer to purchase the relevant products or services.
An automated order confirmation acknowledges receipt of your order but does not necessarily mean that we have accepted it.
We may refuse, cancel or amend an order where reasonably necessary, including where:

an item is unavailable;
-
there has been an obvious pricing or product information error;
-
payment cannot be authorised;
-
we reasonably suspect fraud or unauthorised activity;
-
liquor licensing requirements cannot be satisfied; or
-
the order cannot lawfully or reasonably be fulfilled.
If we cancel an order after payment has been received, we will refund the relevant amount to the original payment method, unless otherwise agreed with you.
Please review your order carefully before submitting it. Once an order has entered processing or dispatch, we may not be able to accommodate a cancellation or amendment.
7. Australian Shipping and Delivery
We deliver wine throughout Australia, subject to applicable laws, carrier availability and delivery restrictions.
Australian orders are generally dispatched using Australia Post.
Delivery timeframes displayed or communicated by us are estimates only. Actual delivery times may be affected by Australia Post operations, weather, regional accessibility, peak periods or circumstances outside our reasonable control.
Customers are responsible for providing a complete and accurate delivery address.
Alcohol Delivery
By default, alcohol deliveries require a signature on delivery.
The person accepting delivery must be 18 years of age or older and may be required to provide acceptable proof of age and identity.
If the recipient's age is uncertain, the delivery provider may request acceptable evidence of age and identity before handing over the alcohol.
Where available through the relevant delivery service, a customer may specifically request Authority to Leave / Leave in a Safe Place.
Alcohol will only be left unattended where:
-
the purchaser has expressly requested or authorised this delivery method;
-
the relevant carrier permits the delivery instruction; and
-
doing so is permitted by applicable law.
Where a delivery cannot be completed because the address provided is incorrect, no eligible recipient is available, or circumstances attributable to the customer prevent delivery, reasonable redelivery or return costs may apply.

8. International Shipping
International shipping may be available to selected destinations.
Greenock Creek Wines works with Get Freighted, a third-party international freight provider, to arrange international wine shipments.
International orders are subject to:
-
destination-country alcohol import laws and restrictions;
-
carrier and freight-provider requirements;
-
customs requirements;
-
availability of international freight services; and
-
any applicable duties, taxes, customs charges or other import-related costs.
We may decline or cancel an international order where the wine cannot lawfully or reasonably be delivered to the requested destination.
Any duties, taxes or import-related charges not included in the price or freight quotation provided to you may be payable by the recipient.
International delivery timeframes are estimates and may be affected by customs clearance, international carriers and circumstances outside our reasonable control.
Additional terms or requirements imposed by Get Freighted or an international carrier may also apply to the freight component of your order.
Nothing in this section limits any rights that cannot lawfully be excluded under the Australian Consumer Law.
9. Refunds, Returns and Damaged Products
Returns, refunds, replacements and other remedies are governed by our Refund Policy [LINK] and the Australian Consumer Law.
We do not generally provide refunds or exchanges where a customer simply changes their mind.
This does not affect any rights or remedies available under the Australian Consumer Law.
If an order:
-
arrives damaged;
-
contains an incorrect product or quantity;
-
is incomplete;
-
contains a wine with a genuine fault; or
-
otherwise fails to meet an applicable consumer guarantee,

We may request reasonable information, photographs or other evidence to assist us in assessing the issue.
Where an incorrectly supplied, damaged or faulty product needs to be returned to us, we will arrange or cover reasonable return postage where required.
Nothing in these Terms or our Refund Policy excludes, restricts or modifies any consumer guarantee, right or remedy available to you under the Australian Consumer Law that cannot lawfully be excluded, restricted or modified.
10. Cellar Door Tastings
Cellar Door tastings booked through our website must generally be booked at least 24 hours in advance, unless otherwise agreed by Greenock Creek Wines.
If you are unable to attend your booked tasting, you may contact us to request either:
-
a full refund; or
-
rescheduling to another available date or time.
If you do not attend your booking (“no-show”), please contact us within 7 days of the scheduled booking to request a full refund or reschedule.
All rescheduled bookings are subject to availability.
Participants consuming alcohol must be at least 18 years of age.
We reserve the right to refuse alcohol service where required by law or our responsible service of alcohol obligations.
11. Basket Press & Blend Experience
The Basket Press & Blend Experience requires advance preparation and must generally be booked at least 48 hours before the scheduled experience.
Customer Cancellations
If you cancel more than 24 hours before the scheduled start time, you may choose:
-
a full refund; or
-
rescheduling to another available date or time.
If you cancel within 24 hours of the scheduled start time, or do not attend your booking, preparation of the materials required for your experience may already have commenced.
In these circumstances, you will be eligible for a 50% refund of the booking amount.
Alternatively, we may offer rescheduling at our discretion, subject to availability and the preparation requirements of the experience.
This cancellation provision reflects the advance preparation required for the experience, including the preparation and thawing of fermented grapes.
Cancellation by Greenock Creek Wines
If we need to cancel your experience and cannot provide the booked service, you may choose between:
-
a full refund; or
-
rescheduling to another available date or time.
Nothing in this section limits any rights you may have under the Australian Consumer Law.
12. Other Events and Experiences
From time to time, Greenock Creek Wines may offer dinners, events, tastings, masterclasses or other experiences.
These bookings may be subject to specific booking, cancellation or attendance conditions displayed at the time of purchase.
Where specific event conditions are provided, those conditions apply in addition to these Terms.
If there is any inconsistency between these Terms and specific conditions clearly provided for an event or experience, the specific conditions will apply to that booking to the extent of the inconsistency, subject to applicable law.
13. Wine Club Memberships
Greenock Creek Wines offers Wine Club memberships with different shipment frequencies and benefits.
Depending on the membership selected, Wine Club shipments may occur from once per year up to four times per year.
The applicable shipment schedule, wines or selection arrangements, member pricing and benefits will be communicated when you join the relevant Wine Club membership.
Minimum Shipment
Each scheduled Wine Club shipment has a minimum purchase of 6 bottles, unless otherwise stated for the relevant membership.
Automatic Payments
By joining a Wine Club membership, you authorise Greenock Creek Wines and its payment provider to charge your nominated payment method for each scheduled Wine Club shipment in accordance with the membership you select.
We will send you a reminder email before each scheduled Wine Club payment is processed.
You are responsible for keeping your contact and payment details current.
Cancellation
Wine Club memberships may be cancelled at any time.
To prevent a future scheduled payment, you should notify us of your cancellation before that payment is processed.

Cancellation will apply to future Wine Club shipments and charges once the cancellation has been received and processed.
If a scheduled payment has already been processed before we receive or process your cancellation request, please contact us as soon as possible. We will discuss the available options with you having regard to whether the relevant order has already been prepared or dispatched and your rights under applicable law.
There is no minimum membership duration unless otherwise expressly stated when you join.
Changes to Wine Club Membership
If we make a material change to the price, frequency or key benefits of your Wine Club membership, we will provide reasonable notice before the affected scheduled payment.
You may cancel your Wine Club membership before the relevant payment is processed if you do not wish to continue under the changed arrangements.
Nothing in these Wine Club terms limits any rights available to you under the Australian Consumer Law.
14. Intellectual Property
Unless otherwise stated, content available through our Services, including our trademarks, wine names, logos, text, photography, graphics, labels, designs, video and other content, is owned by or licensed to Greenock Creek Wines.
Such content is protected by applicable Australian intellectual property laws and, where relevant, international intellectual property laws.
You may access our website for personal and non-commercial purposes.
You must not reproduce, publish, distribute, modify, commercially exploit or otherwise use our intellectual property without our prior written permission, except where permitted by law.
“Greenock Creek Wines” and associated names, logos and branding may not be used without our prior written permission.
15. Third-Party Tools and Links
Our Services may contain links to or integrations with third-party websites, applications, booking systems, payment providers, freight providers, social media platforms or other services.
We do not control third-party services and are not responsible for their independent content, availability or practices.
Your use of a third-party service may also be subject to that provider's own terms and privacy policies.
Nothing in this section excludes or restricts any rights or remedies that cannot lawfully be excluded.
16. Relationship with Shopify
Greenock Creek Wines is powered by Shopify, which enables us to provide the Services.
However, sales and purchases made through our Store are made directly with Greenock Creek Wines.
By using the Services, you acknowledge that Shopify is not the seller of products or services purchased from Greenock Creek Wines and is not responsible for fulfilling those purchases.
To the extent permitted by applicable law, Shopify and its affiliates are not responsible for claims, loss or damage arising from products or services purchased directly from Greenock Creek Wines.
Nothing in this section limits any rights or remedies available to you against Greenock Creek Wines under applicable law.
17. Privacy
Our collection, use and handling of personal information is described in our Privacy Policy [LINK].
Because our online store is hosted by Shopify, certain personal information may also be processed by Shopify and other service providers that assist us in operating our website, processing payments, fulfilling orders, arranging freight, providing bookings, analysing website activity or delivering marketing communications.

18. Website Information, Errors and Availability
We make reasonable efforts to keep information on our website accurate and current.
From time to time, information may contain typographical errors, inaccuracies or omissions relating to matters including product descriptions, vintages, prices, promotions, availability, delivery costs or estimated delivery times.
Where permitted by law, we may correct errors and update information.
If an error materially affects an order you have placed, we will contact you where reasonably practicable and provide any remedy required by applicable law.
19. Availability of the Services
We do not guarantee that our website or online store will always be available, uninterrupted or error-free.
We may update, maintain, suspend or discontinue parts of the website or Services where reasonably necessary.
Nothing in this section excludes rights or guarantees that cannot lawfully be excluded under the Australian Consumer Law.
20. Limitation of Liability
Nothing in these Terms excludes, restricts or modifies any right, guarantee, warranty or remedy that cannot lawfully be excluded, restricted or modified, including rights arising under the Australian Consumer Law.
To the maximum extent permitted by law, Greenock Creek Wines will not be liable for indirect or consequential loss arising from your use of the Services where such liability may lawfully be excluded.
Where liability may lawfully be limited, it will be limited only to the extent permitted by applicable law.
21. Prohibited Uses
You must not use our website or Services:

for an unlawful or fraudulent purpose;

to violate any applicable law or regulation;

to infringe our intellectual property rights or those of another person;

to transmit malicious software or code;

to attempt to gain unauthorised access to our systems;

to collect personal information about others unlawfully;

to impersonate another person;

to interfere with the security or operation of our website; or

in any other way that may reasonably cause harm to Greenock Creek Wines, our customers or third parties.
We may restrict or terminate access to the Services where we reasonably believe these Terms have been materially breached.
22. Feedback and Reviews
If you submit a review, photograph, comment, suggestion or other content to us, you confirm that you have the right to provide that content and that it does not infringe the rights of another person.
Unless otherwise agreed, you grant us a non-exclusive, worldwide, royalty-free licence to use, reproduce and display content that you voluntarily provide to us for purposes reasonably connected with operating, marketing or promoting Greenock Creek Wines and our Services.
We will handle any personal information associated with such content in accordance with our Privacy Policy.
23. Termination
You may stop using our Services at any time.
We may suspend or terminate your access to our Services where reasonably necessary, including where you materially breach these Terms, engage in unlawful activity or misuse our website or systems.
Rights and obligations which by their nature are intended to continue after termination will continue to apply.
24. Changes to These Terms
We may update these Terms from time to time to reflect changes to our Services, business practices or legal obligations.
The current version will be published on this page together with its last-updated date.
Where required by law, we will provide appropriate notice of material changes.
Material changes to an existing Wine Club membership will be handled in accordance with the Wine Club provisions above.
25. Governing Law
These Terms are governed by the laws of South Australia, Australia.
Subject to any rights you may have under applicable consumer law, the parties submit to the jurisdiction of the courts and tribunals of South Australia and any courts entitled to hear appeals from them.
